Avatar Flow

1. Acceptance of these terms

These Terms form an agreement between you and GREEN VIREO LLC, a Wyoming limited liability company (Wyoming File ID 2024-001555850), doing business as Avatar Flow. By creating an account, purchasing credits or a subscription, submitting content, or using Avatar Flow, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be legally able to enter into this agreement and comply with the laws that apply to your use of Avatar Flow. If you use Avatar Flow for an organization, you represent that you have authority to bind that organization to these Terms.

3. Your account

You are responsible for maintaining control of your account and for activity performed through it. Provide accurate account information, keep your credentials secure, and promptly report suspected unauthorized use through in-app support. We may suspend or restrict access where reasonably necessary to protect users, the service, or legal compliance.

4. Your content and permissions

You retain ownership of the images you submit. You grant Avatar Flow a limited, non-exclusive, worldwide right to process those images solely to operate the requested generation, store the resulting files in your private history, provide downloads, and support the service.

You must have every right, permission, and consent necessary to upload or capture each image. This includes permission from every identifiable person in the image. Do not submit content that is unlawful, infringes intellectual-property or privacy rights, exploits or sexualizes minors, impersonates another person deceptively, or violates applicable rules or law.

5. AI-generated results

Avatar Flow uses AI systems to create new images and motion assets from your source image and settings. Results are generated automatically and can vary. A result may not match a preview, a prior output, an example, a particular style, or your expectations. You are responsible for reviewing a result before publishing, sharing, or using it commercially.

Subject to your compliance with these Terms and any applicable third-party rights, you may use the results generated for your account. We do not guarantee that a result is exclusive, non-infringing, suitable for a specific purpose, or available forever. You must not present an AI-generated result as authentic evidence, impersonate someone, or use it to mislead others.

6. Credits, subscriptions, and add-ons

• Each generation type has a credit cost shown in the app. The server determines the final charge and enforces available credit limits.
• A subscription grants a recurring allowance of subscription credits for its weekly or monthly billing period. Subscription credits refresh at the beginning of a new active period and do not carry forward to a later period.
• Credit add-ons are separate from subscription credits. They remain available until used, subject to account deletion, fraud prevention, legal requirements, or other rights described in these Terms.
• Avatar Flow reserves credits before generation work begins, commits them after successful processing, and returns them when processing ultimately fails due to the service.
• We may change product availability, credit costs, or plan features for future purchases or renewals. A change does not retroactively alter a verified entitlement for an already active period unless required by law or the store.

7. Payments, renewal, cancellation, and refunds

Apple App Store and Google Play process purchases. The store displays the current price, currency, tax treatment, billing period, and renewal terms before you confirm payment. Subscriptions renew automatically unless you cancel them through the store before the applicable renewal deadline. Cancellation generally stops the next renewal; access continues through the already paid period unless the store or law provides otherwise.

Refunds, chargebacks, subscription management, and purchase disputes are governed by the applicable store’s policies and law. We activate paid access only after server-side verification of the relevant store transaction. We may remove or adjust entitlements where a store reports a refund, revocation, chargeback, or invalid transaction.

8. Free previews and downloads

Where Avatar Flow offers a free or watermarked preview, it is provided for evaluation only. A clean, non-watermarked download requires the entitlement shown in the app. You may not remove, obscure, or bypass a watermark or paid-download control.

9. Acceptable use

You may not use Avatar Flow to create, request, distribute, or facilitate content that is illegal, abusive, hateful, sexually exploitative, fraudulent, deceptive, invasive of privacy, infringing, or harmful. You may not interfere with the service, attempt to bypass payments or technical controls, scrape private content, use another user’s account, reverse engineer the service except where law expressly permits it, or use automated means that overload or compromise the service.

10. Availability and changes

Avatar Flow depends on mobile platforms, networks, storage services, and AI providers. Generation, download, or notification delivery may be delayed, unavailable, or interrupted. We may modify, suspend, or discontinue features when reasonably necessary to operate, secure, improve, or comply with law. We do not guarantee uninterrupted availability or that every generation request will succeed.

11. Suspension and termination

You may stop using Avatar Flow at any time and can delete your account in the app. We may suspend or terminate access for a material breach of these Terms, suspected fraud or abuse, security risks, or legal compliance. Ending access does not remove obligations that by their nature should survive, including payment obligations, restrictions on misuse, and provisions relating to liability.

12. Disclaimers and limitation of liability

To the maximum extent permitted by law, Avatar Flow is provided “as is” and “as available.” We disclaim warranties that are not expressly stated in these Terms, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted service. To the maximum extent permitted by law, Avatar Flow will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity arising from use of the service.

To the maximum extent permitted by law, the total liability of GREEN VIREO LLC and its officers, directors, employees, and service providers for all claims relating to Avatar Flow will not exceed the greater of the amount you paid to Avatar Flow for the service in the 12 months before the event giving rise to the claim or US$100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless GREEN VIREO LLC and its officers, directors, employees, and service providers from claims, damages, liabilities, costs, and expenses arising from your content, your use of Avatar Flow, or your violation of these Terms or applicable law.

14. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Except where applicable law requires otherwise, you and GREEN VIREO LLC agree that courts located in Laramie County, Wyoming will have exclusive jurisdiction over disputes arising from these Terms or Avatar Flow.

15. Changes to these terms

We may revise these Terms when the service, legal requirements, or commercial terms change. The updated version will be published here with a revised effective date. Continued use after the effective date means you accept the updated Terms, unless applicable law requires another form of notice or consent.
